Geophysicist Gets NIW Approved Despite RFE Dr. Kim* originally contacted our firm about applying for a national interest waiver (NIW). He was seeking to obtain permanent residence in the United States, and he hoped that with the help of an experienced immigration attorney, he would be able to skip the labor certification process and obtain his green card sooner. Dr. Kim had a Ph.D. in Geophysics from a major U.S. university. When he contacted our firm, he had been working for a big energy company for less than a year; since his work was contributing toward the energy industry, it was arguably in the national interest. Dr. Kim had a solid record of first-author publications and conference presentations, and a few professional memberships in his field. Attorney Xu talked to Dr. Kim and advised him on the additional evidence to be prepared, including several more letters of recommendation, and submitted the response to the RFE in mid-November. Less than two weeks later, on the last day of November, Dr. Kim’s case was approved. Dr. Kim said, “I really appreciate the help from your office, especially Attorney Xu and [Attorney Zhang].” Attorney Xu and Attorney Zhang were happy, too.
