IT Professional Receives Green Card through NIW

Mr. Gupta* initially contacted our firm about pursuing employment-based immigration. Mr. Gupta was an IT professional at a major high-tech company. He had a master’s degree in his field and an impressive performance record. In particular, Mr. Gupta had designed an innovative piece of software that had saved his company a significant amount of money.

Mr. Gupta came to our firm because he was interested in filing a national interest waiver (NIW) application, which would allow him to file on his own behalf and avoid the labor certification process. Mr. Gupta exchanged a few emails with Attorney Jerry Zhang and eventually set up a free consultation with him. Attorney Zhang warned Mr. Gupta that NIW applications were difficult for IT professionals, since more and more people were applying for them each year—particularly in the IT field—and USCIS was becoming increasingly strict, issuing more denials and requests for additional evidence.

Nonetheless, Mr. Gupta wanted to give it a try, and he retained the firm for his NIW case later that month. He worked with our firm to prepare strong recommendation letters, and one of our experienced immigration attorneys drafted his petition letter.

Despite the relative difficulty many IT professionals have with NIW applications, Mr. Gupta’s application was successful. Once Mr. Gupta received his approval notice, he retained the firm again for his and his wife’s I-485 applications, which were submitted to USCIS the next month.

While Mr. Gupta and his wife waited for their green cards, they had a few other things to take care of as well. At one point, Mr. Gupta needed the appropriate documentation to travel outside the United States. He also needed an employment authorization document (EAD) so that he could continue to work while waiting for his I-485 to be approved.

Mr. Gupta worked with our firm to take care of all of these needs. When our firm filed his applications for the travel document and EAD, both applications were approved the next month.

Finally, at the end of November 2007, Mr. Gupta’s I-485 application was approved, and he and his wife received their green cards in the mail.
