The Department of State released the latest Visa Bulletin for January 2008 on December 12, 2007. The most notable development reflected in this Visa Bulletin is yet another major retrogression of the cutoff date for Indian EB-2 cases. After falling back two years and three months in the December bulletin, the cutoff date for India-born EB-2 applicants regressed yet another whole year.
The cut off date for Chinese EB-2 cases did not change, remaining at Jan. 1, 2003.
The other cut-off dates remained stable, with a few small gains in the third preference category. In that category, the cut-off date for the Philippines and “Other Countries” moved ahead six weeks, while China advanced two weeks.
This latest news represents yet another set-back for potential EB-2 immigrants born in India. In light of the situation, we reiterate the advice stated in our December Visa Bulletin Update, and suggest that China and India-born applicants file in the EB-1 category, which remains current for all countries, if at all possible.
We believe the current lack of progress can be attributed to the continuing clarification of statistics for the high volume of cases filed in July and August 2007, when visa numbers became available for all EB cases. We may see slow movement or non-movement in the near future, as the DOS and USCIS work to determine accurate numbers for these cases.
The following are the January cut-off dates for employment-based immigration petitions.
