Recent Developments on PERM Approval Time

In our news article on July 22, we reported that Department of Labor (hereafter, DOL) made an announcement at the recent AILA annual conference about the normal processing times and inquires. The DOL specifically designated the “normal processing time” for the PERM employer or attorney receiving DOL responses (approval, audit, denial) as 90 days after a submission.

In the past few weeks, attorneys on our PERM specialty team have successfully filed multiple PERM petitions. In most cases, we received the DOL approval decision within 2 weeks after our online submission. Our experience with shorter processing times demonstrates that the DOL takes its promise of a 90 day normal processing time seriously. We will closely monitor any change of DOL processing times for PERM petitions.
