E-file Your Case to Buy 7 More Business Days after Filing

As we know, if an applicant wants to file I-485 applications in August, 2007, he/she must file his/her I-140 applications before August 1, 2007. As the deadline is approaching, some I-140 applicants still cannot make their applications ready before the deadline.

Here is the solution: you can e-file your I-140 application, and submit all supporting materials within 7 business days after the date of the e-filing. The supporting documents, including petition letter, recommendation letters and others, may be submitted within seven business days. Therefore, efiling can buy the applicants 7 more business days to prepare their applications.

Data of an e-filed case will be entered into the USCIS Siebel system automatically. USCIS will immediately issue a receipt for the e-filing. Moreover, USCIS will issue paper receipt notice afterwards. The priority date of an e-filed I-140 petition, if the I-140 is not based on a LC, is the e-filing date. For example, an e-filed I-140 petition filed on July 29, 2007 reserves a priority date of July 29, 2007 if the supporting documents are received by USCIS on or before August 7, 2007. In this case, you only need to pay $195 as the filing fee. Moreover, an e-filed I-140 petition filed on July 31, 2007 has a priority date of July 31, 2007 if the supporting documents are received by USCIS on August 9, 2007. In this situation, you need to pay $475 as the filing fee. In either situation, you can then file your I-485 application before August 18.

Another benefit of e-filing is to help you file your case before USCIS new fee takes effect on July 30. As discussed above, if you e-file your case on or before July 29, you pay the old filing fee of $195.

Then, you can still file your I-485 until August 17.
