Breaking News: DHS Published H-1B "Cap Gap" Notice

On July 23, 2004 the Department of Homeland Security issued a memo concerning F or J status aliens who have a "Gap" between the end of their F or J status and the October 1, 2004 issuance new H-1B visas. The memo allows F or J status aliens to stay legally in the US until their newly approved H-1B status starts on October 1, 2004. The memo requires that the H-1B petitions must be filed by July 31, 2004.
