NOTICE TO ALL CUSTOMERS WITH A PENDING I-130 PETITION

Starting July 15, 2004, the USCIS will adjudicate I-130 Petitions (Alien Relative Petitions) only when a visa number becomes available. Previously, the USCIS has adjudicated pending I-130 prior to a visa number becoming available. Under the previous system, upon approval of the I-130 the Beneficiary would wait (sometimes for a number of years) until a visa number was available and then the Beneficiary would file an Immigrant Visa petition. Under the new system, the I-130 will not be adjudicated until a Visa Number is available.

This change is being made so that the USCIS can focus on petitions for which visas are actually available. This change will not impact “Immediate Relative Petitions” (Spouse, Children, Parents of US Citizens) because visa are always available for such cases.
