I-485s to Be Filed At NSC from July 24th

U.S. Citizenship and Immigration Services (USCIS) announced on June 30th that starting on July 24th, all applicants filing an Application to Adjust Status or Register Permanent Residence (Form I-485) based on a pending or an approved Immigrant Petition for Alien Worker (Form I-140), also referred to as a “standalone filing”, should mail that form directly to the Nebraska Service Center (NSC). Applicants should file accompanying forms (e.g., Form I-131 Application for Travel Document, and/or Form I-765, Application for Employment Authorization) at this same centralized location.

This is the second phase of bi-specialization of USCIS. The first adjustment as we all know was that as of April 1st, the concurrent I-140/I-485 filings should be submitted to the Nebraska Service Center; and standalone I-485 filings submitted before July 24th to the location where Form I-140 was pending or had already been approved, according to the filing instructions in effect at that time. But starting from July 24th, these I-485 forms should also be mailed directly to the NSC.

We have learned that from April 1st, all the I-129 forms should be submitted to the Vermont Service Center (VSC), while the I-140 applications should be filed to Nebraska Service Center (NSC). Then, VSC will send part of the I-129 forms to California Service Center (CSC), while NSC will send part of the I-140 forms to the Texas Service Center (TSC). In other words, from April 1st, VSC and CSC are dedicated to deal with I-129 and accompanying applications, while NSC and TSC focus on I-140 and related green card applications. This adjustment has not only balanced the workload and the processing speed of each service center, but also made the immigration process even more specialized.

As the NSC will send part of the I-485 applications to TSC, an applicant should pay attention to the exact center name when receiving the receipt notice, because the center which sends out the receipt is just the one adjudicating the case. And if the applicant also needs to file the I-131 and I-765 before the I-485 is approved, he/she needs to file them to the service center which is adjudicating the I-485(NSC or TSC, reflected on the receipt).
