USCIS announced it would reject all I-485s received on 7/2/07 because no visa numbers are available for July 2007. Will the I-140’s that were concurrently filed with the I-485s also be rejected?
According to the USCIS’s notice to AILA, they will process the I-140 if it is paid with a separate check. If there is only one check for both the I-140 and the I-485, USCIS will reject the whole package, and allow the petitioner to re-file the I-140 alone.

We urge that those who can file the I-140 petition (NIW, EB-1A or EB-1B) to file it as soon as possible to receive an earlier priority date, and in turn they will receive an immigration visa (eligibility to file I-485 application) earlier.
