H1B Visa Cap Updates as of May 12

The USCIS released the latest count on H1B cap. As of May 12, there were 34,808 cases filed against the 58,200 standard H1B cap for Fiscal Year 2007, and 6,033 cases were approved, with 23,392 remaining in the cap. In the same period, 4,638 cases were filed against the 20,000 new H-1B visas for foreign workers with a master's or higher level degree from a U.S. academic institution, and 1,392 cases were approved, with 15,362 being left in this category. The following is the detailed table of the updates.

Based on the current pace of filing reported by USCIS, we predict that the standard H1B cap could be met in late June or early July 2006, and the master and above degree cap could be met in September 2006. As can be seen from the last USCIS report, it is hard to predict a stable trend in case filing. What we can do is to encourage anyone who can file an H1B petition do so as soon as possible.

* Refers to the estimated numbers of beneficiary applications needed to reach the cap, with an allowance for denials and revocations. Each target is subject to revision later in the cap cycle as more petitions are processed.

** 6,800 are set aside for the H-1B1 program under terms of the U.S.-Chile and U.S.-Singapore Free Trade Agreement. Unused numbers in this pool can first be made available for general use on October 1, 2006 , the start of FY 2007.
