EB Visa Bulletin of June ‘08 Keeps Moving Ahead

The Department of State released the June Visa Bulletin on May 12. It shows some positive change for applicants born in China and India, with EB-2 moving ahead three months. Other categories barely changed.

The following are cut-off dates for employment-based immigration petitions. The dates in parentheses are the cut-off dates from last month.

For people born in mainland China:
EB-1: Current (Current)
EB-2: April 1, 2004 (January 1, 2004)
EB-3: March 22, 2003 (March 22, 2003)

For people born in India:
EB-1: Current (Current)
EB-2: April 1, 2004 (January 1, 2004)
EB-3: November 1, 2001 (November 1, 2001)

For all chargeability areas except China, India, Mexico, and Philippines:
EB-1: Current (Current)
EB-2: Current (Current)
EB-3: March 1, 2006 (March 1, 2006)

The visa bulletin for EB-2 and EB-3 for people born in China and India has been stagnant for a quite a while. With many employment-based immigration petitions waiting in USCIS, we don’t expect to see big leaps for EB-2 and EB-3. However, there have been no visa bulletin issues for EB-1 green card applications, which is a big advantage.  

Recently, Representative Zoe Lofgren (D-CA), chair of the House Subcommittee on Immigration, and other Representatives introduced two immigration bills (H.R. 5882 and H.R. 5921) to the U.S. House of Representatives to recapture immigrant visas lost to bureaucratic delays and to eliminate the per-country limits of employment-based immigrant visas. If these bills become laws, they could significantly ease the current tight immigration visa bulletin.
