PERM - New Trends in 2008 All PERM Cases to be Processed at the Atlanta Center Jian Joe Zhou, Attorney at Law According to recent reports from a liaison meeting between officers of the Department of Labor (DOL) and members of the American Immigration Lawyers Association (AILA), the DOL is going to move all green card PERM cases to its Atlanta Processing Center, leaving the Chicago Processing Center free to focus on temporary Labor Certification cases for H-2 temporary worker visas. The DOL expects the re-allocation of these cases to occur this summer. Presently, both the Chicago Processing Center and the Atlanta Processing Center divide PERM permanent cases according to a geographic division created by the DOL. The Chicago Processing Center has a good reputation for timely adjudication of cases, the majority of which have been adjudicated within 2 months, with many approved in a couple of days. The Chicago Center is also relatively good at adjudicating audit responses. In contrast, the Atlanta Center has usually been slow at processing, with many cases taking more than 2 months to adjudicate. However, immigration lawyers nationwide have noted a recent slowdown in processing permanent residence cases by the Chicago Center due to a draw on its resources for adjudicating temporary Labor Certification cases for H-2 worker visas. This is because there is a legislative deadline for adjudication of H-2 temporary labor certification applications that the DOL has to meet, while there is no mandatory legislative deadline imposed on PERM cases.
