The U.S. Department of Labor (DOL) Office of Foreign Labor Certification recently released statistics for the PERM Labor Certification applications it processed in Fiscal Year 2007 (October 1, 2006 – September 30, 2007) and the beginning of Fiscal Year 2008 (October 1, 2007 – December 31, 2007).
These statistics do not reveal any significant changes in PERM certification policy, nor do they indicate any surprising new trends in PERM applications. However, it is always valuable to consider the numbers because they paint an accurate picture of the current PERM Labor Certification picture.
Highlights from the first quarter of Fiscal Year 2008 (October – December, 2007)
- 20,667 applications were received so far in the first three month of FY 2008;
- During the first three months of FY 2008, DOL adjudicated approximate 16,100 applications (not necessarily filed in FY 2008, many filed prior to FY 2008), 12,500 were certified, 2,800 were denied and 800 were withdrawn. This approval rate of 77% closely matches the average certify/deny/withdraw ratio from the past few years, in which the average approval rate has been 78%.
- As of December 31, 2007, there were 23,000 cases active pending at the DOL. 44% of those cases are in audit review, and 14% are in Reconsider or Appeals.
Highlights from Fiscal Year 2007 (October 1, 2006 – September 30, 2007)
- 85,112 Labor Certification applications were certified;
- Top states for PERM foreign workers were: California, New York, New Jersey, Texas and Florida
- Alien beneficiaries came from 176 different countries. Top countries of citizenship for beneficiaries were: India (24,573), China (6, 846), Mexico (6,442), South Korea (5,159) and Canada (4,837);
- Top job titles for permanent employment were: Computer Software Engineers (15,560), Computer Systems Analysts (4,012), Restaurant Cooks (2,642), Computer and Information Systems Managers (2,235) and Electronics Engineers (2,090)
