I-140/I-485 New Filing Locations as of 7/30/07

USCIS announced new filing locations for the I-129F, I-131, I-140, I-360, I-485, I-765 and I-907 forms, effective July 30, 2007. Under the new “Direct Filing” procedure, applicants should file their applications to either the Texas Service Center or the Nebraska Service Center based on the state where they reside.

The effective date of the “Direct Filing” instructions for all of forms I-129F, I-131, I-140, I-360, I-485, I-765 and I-907 is July 30, 2007. During the first 30 days of “Direct Filing” (July 30 to August 28), USCIS will not reject any form that was incorrectly filed at the prior filing location. However, applicants must include the correct fee and must meet all other requirements for a proper filing. Starting from August 29, 2007, USCIS will reject any of the forms listed above that are filed with the incorrect filing location.

Please note, the filing location of the I-140 is determined by the employment place, whereas the filing location of I-485 is determined by the petitioner’s residence place. The following filing locations are good for the I-140 filing alone, or concurrently with the I-485. Employment-based I-485s filing alone use the following instruction too.

Texas Service Center (TSC) covers the following states:

Alabama, Arkansas, Connecticut, Delaware, the District of Columbia, Florida, Georgia, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Mississippi, New Hampshire, New Jersey, New Mexico, New York, North Carolina, South Carolina, Oklahoma, Pennsylvania, Puerto Rico, Rhode Island, Tennessee, Texas, Vermont, Virginia, U.S. Virgin Islands, or West Virginia.

Nebraska Service Center (NSC) covers the following states:

Alaska, Arizona, California, Colorado, Guam, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, North Dakota, Ohio, Oregon, South Dakota, Utah, Washington, Wisconsin, or Wyoming
