"Attorney comments: EB-3 PERM based petition for a beneficiary who has never worked in the US.  The US employer petitioned for PERM and I-140, both received timely approval.  Then, the case went through consular immigrant visa application and received approval for immigration visa.  An alien worker doest not need to be in the US for the immigration petition process.  The alien worker is required to work for the US employer only when green card is approved."
