EB-5 Statistics

As you know, applicants for EB-5 visas must agree to invest at least $1,000,000 into a business in the United States, or $500,000 if the business is located in regional center or a targeted employment area (TEA).

Nevertheless, a million dollars will not necessarily buy you guaranteed permanent residency in the U.S. In fact, a not insignificant proportion of EB-5 applicants are ultimately denied permanent residency.

Denials can occur at two stages of the EB-5 application process: the initial I-526 stage or the I-829 stage, when EB-5 applicants petition to remove the conditions on their permanent residency.

In this article, we’ll break down some of the approval and denial data for EB-5 applications.

I-526 Statistics

According to published U.S. Citizenship and Immigration Services (USCIS) information, I-526 receipts, approvals, and denials have been increasing steadily over the years. Overall, the proportion of approvals compared to the total number of petitions adjudicated in a given year (approvals plus denials), has averaged 83 percent over the last nine years.
