Attorney’s Fees and Filing Fees

For better or for worse, the business of immigration is a costly one. When they retainour experienced attorneys for an EB-5 visa, intending immigrants are responsible for both filing fees and attorney’s fees. Filing fees are charged by U.S. Citizenship and Immigration Services (USCIS) for administrative processing, while attorney’s fees are paid to Zhang & Associates for our professional services.

Below are breakdowns of costs for your reference.

Attorney’s Fees: I-526 Petition


In total, we generally charge $22,500 for an EB-5 direct investment petition and $15,000 for an EB-5 regional center petition. Each includes the process spanning submission of Form I-526 through obtaining a conditional green card for the alien investor (as well as for any derivative beneficiaries, i.e. spouses and/or unmarried children under the age of 21).

We break down below the total fees into installments due at specific points while facilitating an EB-5 case.

Immediately upon USCIS approval of Form I-526

This fee must be remitted prior to facilitating your I-485 petition or consular processing.

Installment 4

Before submitting Form I-485 or undergoing consular processing

During this time:

  1. If you’re located in the U.S., we prepare the I-485 petition, submitting the completed package to USCIS.
  2. If you’re located abroad, we prepare your consular processing.

If you are investing in a regional center, we’ll recommend a regional center (if you are amenable) and provide a feasibility inspection and analysis of the regional center you ultimately choose. We’ll also perform due diligence work for all documentary evidence.

Installment 2

$4,000

Before filing Form I-526

During this stage, we will prepare, review, assort, and finalize all forms and supporting documentation for your I-526 petition package.

Installment 3

$1,000

Immediately upon USCIS approval of Form I-526; before retaining the firm for Form I-485 or undergoing consular processing

This fee must be remitted prior to facilitating your I-485 petition or consular processing.

During this time:

  1. If you’re located in the U.S., we prepare the I-485 petition, submitting the completed package to USCIS.
  2. If you’re located abroad, we prepare your consular processing.

Attorney’s Fees: I-829 Petition

We charge separate attorney’s fees to facilitate the removal of conditions on our EB-5 clients’ conditional permanent resident status.

  • For EB-5 direct investment cases, the Form I-829 attorney’s fee is $12,000.
  • For EB-5 regional center cases, the Form I-829 attorney’s fee is $8,000.

Moreover, they represent the majority of cases in each category. An individual client may be charged at a higher, or lower, fee, depending on the totality of circumstances of the client’s case. Zhang & Associates reserves the right to charge a higher fee than those tabulated in the fee schedule above. Note that fees listed above do not include any personal appearances by your attorney at USCIS offices or in court.
