Unlawful activities and their impact on adjustment of status

A person who at the time of entry was inadmissible will be automatically barred from adjustment of status.

For more information regarding unlawful activities subject to bar from admission, click here. If any of the circumstances that would render someone inadmissible apply to you and you are seeking adjustment of status, you should consult with an experienced attorney.

Also, a person who made an illegal entry into the U.S.,(i.e. entered without inspection), is barred from adjustment of status. There is an exception (245(i)) to this rule that allows a person who entered without inspection to adjust his/her status. However, certain special conditions are required for this exception. For more information on 245(i), click here.
